Lease - Residential
Expatriates will find that rented accommodation
falls under two categories, namely tenancies & licences.
A tenancy of rented accommodation must be in writing and
over one year in duration. Shorter lettings are subject
to approval by the relevant Government department.
Tenants are protected under law and enjoy security of tenure.
There are strict procedural rules to follow should a landlord
wish to terminate a tenancy or to increase the rent. Our
panel of lawyers can advise on these issues.
Some contractual terms in a tenancy agreement are onerous
on tenant therefore legal advice should be sought before
signing such agreements, for example, if a tenant wishes
to have an option to terminate the tenancy earlier than
the full term, a break clause should be incorporated in
the agreement.
Sale & Purchase
of Property
In Hong Kong all real property is held
on leasehold from the Hong Kong Government. There is no
Land Title Registry at present in Hong Kong therefore there
is no guarantee of good title when a person purchases a
flat. In this regard it is recommended that prospective
purchasers should instruct a law firm to check title and
handle the conveyancing.
There are no longer scale fees in
Hong Kong conveyancing. Our panel of lawyers are amenable
to negotiating fees which are acceptable to both the purchaser/vendor
and the lawyer.
